1. Agreement and eligibility

These Terms of Service (“Terms”) form a legally binding agreement between you and My Game Archive (“MGA,” “we,” “us,” or “our”) concerning the MGA website, applications, and related services (collectively, the “Service”). By creating an account, clicking an acceptance control, or using the Service after these Terms are presented to you, you agree to these Terms. If you do not agree, do not create an account or use the Service.

You must be at least 13 years old to use the Service. If you have not reached the age of majority where you live, you may use the Service only with the authorization and supervision of a parent or legal guardian who agrees to these Terms on your behalf. You may not use the Service if applicable law prohibits you from doing so.

2. Accounts and security

Account access is currently provided through Google authentication. You must provide accurate information, maintain the security of your Google account and devices, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account except to the extent caused by our failure to use reasonable safeguards. Accounts are personal and may not be sold, transferred, or shared in a way that compromises security.

3. The Service

MGA helps users catalogue games, track play activity and achievements, create lists and schedules, connect supported gaming accounts, and participate in community features. Features, integrations, availability, and storage limits may change. We may modify, suspend, or discontinue a feature where reasonably necessary for security, legal, operational, or product reasons. We will provide reasonable notice of a material discontinuation when practicable.

The Service may display information supplied by IGDB, Steam, community members, and other sources. Third-party data may be incomplete, delayed, or inaccurate and is provided for convenience.

4. Your content and permissions

You retain ownership of content you submit, including reviews, comments, lists, images, profile details, and catalogue contributions (“User Content”). You grant MGA a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display, distribute, and technically modify your User Content only as needed to operate, secure, improve, and promote the Service. This licence ends when your content is deleted, except for reasonable backup periods, content retained for legal or safety reasons, and content already shared by others where removal is not reasonably possible.

You represent that you have the rights needed to submit User Content and that it does not infringe intellectual property, privacy, publicity, or other rights. Public content may be viewed, copied, or shared by other users, so do not publish information you wish to keep private.

5. Acceptable use

You must not: violate law or another person’s rights; harass, threaten, exploit, or impersonate others; submit unlawful, defamatory, deceptive, hateful, sexually exploitative, or malicious material; expose another person’s private information without authority; interfere with Service security or availability; introduce malware; scrape or access the Service by automated means except as expressly permitted; evade limits or enforcement; manipulate engagement; or use MGA to send spam or conduct unauthorized commercial activity.

We may remove content, limit features, suspend accounts, or preserve and disclose information where reasonably necessary to enforce these Terms, protect users, comply with law, or address security and abuse. We will consider context and proportionality where practicable.

6. Third-party services and intellectual property

Google, Steam, IGDB, hosting providers, and other third-party services are governed by their own terms and privacy practices. MGA does not control and is not responsible for third-party services. Connecting an integration authorizes the exchanges described at the time of connection and in our Privacy Policy; you may disconnect supported integrations through the Service or the third party.

MGA’s software, design, branding, and original content are owned by or licensed to MGA and are protected by applicable laws. Except for normal use of the Service, no rights are granted to copy, modify, distribute, sell, reverse engineer, or exploit those materials. Third-party names, game art, trademarks, and data remain the property of their respective owners. MGA is not endorsed by Google, Valve, Steam, Twitch, or IGDB unless expressly stated.

7. Copyright and rights notices

If you believe content on MGA infringes your rights, send a detailed notice to privacy@mygamearchive.com identifying the work, the allegedly infringing material and its location, your contact information, the basis of your claim, and a good-faith statement that the information is accurate. We may forward the notice to the affected user where permitted.

8. Privacy and advertising

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. Our Cookie Policy describes cookies and similar technologies. The policies are incorporated into these Terms by reference, but consent to optional data practices is requested separately where required.

MGA currently displays no advertisements. We may introduce advertising, including Google-served contextual or personalized advertising, in the future. Before activating advertising technologies that require consent, we will update our disclosures and consent controls. Advertising availability will not alter rights that cannot lawfully be waived.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” MGA does not promise uninterrupted or error-free operation, permanent retention of content, or the accuracy of community or third-party data. Nothing in these Terms excludes warranties, remedies, or rights that cannot lawfully be excluded, including applicable consumer protection rights.

10. Limitation of liability

To the maximum extent permitted by law, MGA and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, data, or opportunities arising from the Service. MGA’s aggregate liability arising from the Service will not exceed the greater of CAD $100 and the amount you paid MGA in the 12 months before the event giving rise to the claim.

These limitations do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, infringement of rights, or any liability that cannot lawfully be limited. The limitations apply only to the extent permitted in your jurisdiction.

11. Indemnity

To the extent permitted by law, you will indemnify MGA against third-party claims and reasonable costs arising from your unlawful User Content, your material breach of these Terms, or your misuse of the Service. This obligation does not apply to the extent a claim was caused by MGA. We will give reasonable notice of a covered claim and permit your participation in its defence, while retaining control where our interests require it.

12. Deactivation, deletion, and termination

MGA does not currently offer a separate account-deactivation state. You may make your profile private, disconnect supported integrations, or stop using the Service without deleting your account. You may permanently delete your account through Settings → Account. Deletion removes your profile, library, lists, likes, connections, messages, schedules, achievements, and private uploads. Lists owned by you and the comments and likes attached to those lists are deleted together.

To avoid destroying replies written by other people, a threaded game comment that must remain as a parent row is replaced with an anonymous removal notice. Your name, handle, profile link, original text, rating, playtime, and reactions are removed. Shared catalogue entries you contributed may remain without account attribution where needed to preserve catalogue integrity. Account deletion cannot be undone.

We may suspend or terminate access for a material or repeated breach, security risk, legal requirement, or discontinuation of the Service. Where appropriate, we will provide notice and an opportunity to remedy. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, dispute terms, and accrued rights—will survive.

13. Changes to these Terms

We may update these Terms to reflect legal, security, or Service changes. We will post the revised Terms and update the effective date. For material changes, we will provide additional notice and request renewed acceptance where required. Changes apply prospectively. If you do not agree to revised Terms, you must stop using the Service and may close your account.

14. Governing law and disputes

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any mandatory right you have to bring a claim elsewhere, the courts located in Ontario have non-exclusive jurisdiction. Before filing a claim, you and MGA agree to make a good-faith effort for 30 days to resolve the dispute informally by written notice. Nothing limits either party’s ability to seek urgent injunctive relief or use an eligible small-claims process.

15. General

These Terms and the incorporated policies are the entire agreement about the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; MGA may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Service, subject to applicable law. Electronic notices and acceptance have the same effect as paper communications where law permits.
